CRS Analysis: American Detention Fears are Overblown

Homeland Security Today: Claims that the recently enacted National Defense Authorization Act for fiscal year 2012 (NDAA) has given the federal government the power to militarily detain US citizens arrested in the US on charges of terrorism appear to have been overblown, according to a new Congressional Research Service (CRS) report.

The Dec. 8, 2011 report, Detainee Provisions in the National Defense Authorization Bills by legislative attorneys Jennifer Elsea and John Garcia, also tends to agree with what backers of the legislation have said all along, which is that the government’s application of what critics of the bill maintain the legislation authorizes -- military arrest and indefinite detention of US citizens on US soil on terrorism charges -- would undoubtedly be challenged in the courts.
