Civilian employees working in Iraq will continue to be eligible for premium pay cap waivers until Dec. 31, 2018, due to President Donald Trump’s recent notice continuing the national emergency designation for the country.

“As a result of this notice, agency heads may continue to apply — through the end of 2018 — a special premium pay cap waiver authority for eligible civilian employees working in Iraq based upon the national emergency. The United States currently has a contingency operation in Iraq (Operation Inherent Resolve), so the higher premium pay cap may be applied to eligible employees working in Iraq in support of that operation on that basis as well,” wrote Mark Reinhold, Office of Personnel Management associate director of employee services, in a Aug. 8 memo to human resources directors.

The National Defense Authorization Act of 2018 established the pay extension for civilian employees working overseas, which was only applicable to eligible employees in Iraq through May 22, 2018. The national emergency designation allows that applicability to extend through the end of 2018.

The national emergency designation itself extends to May 22, 2019, but the 2019 NDAA would have to continue to waive pay limitations for federal employees working overseas for the premium pay authorizations to extend to that date.
