Kavanaugh pick threatens EPA policies, FERC authority, lawyers say

Utility Dive: Judge Brett Kavanaugh will bring enhanced skepticism toward environmental regulation to the Supreme Court and could threaten the foundations of independent federal agencies if he is confirmed by the Senate, energy lawyers tell Utility Dive.

On Monday, President Donald Trump announced he would appoint Kavanaugh, a judge on the D.C. Circuit Court of Appeals and a former George W. Bush administration staffer, to fill the seat on the High Court set to be vacated by Justice Anthony Kennedy, who will retire at the end of the month.
